For most Louisiana injuries on or after July 1, 2024, you have two years from the date of injury. Injuries before that date generally fall under the prior one-year period. Texas gives you two years. Federal maritime claims often run three. Some deadlines are shorter, so the moment you suspect you have a claim is the moment to call.

It depends on when it happened. For Louisiana injuries on or after January 1, 2026, you recover nothing if you are found 51 percent or more at fault, and below that your recovery is reduced by your share. Injuries before that date fall under the old rule, where you could recover no matter your percentage. Texas has used a 51 percent bar for years. Either way, the carrier now has a strong financial reason to push blame onto you, which is why preserving evidence early matters more than it used to.
