Coverage is the case
Louisiana's minimum liability limits do not go far against a hospital bill. Your own uninsured and underinsured motorist coverage frequently carries more than the at-fault driver's policy, and it is the first thing we look for rather than the last.
Fault is now a cliff, not a slope
For Louisiana crashes on or after January 1, 2026, being 51 percent or more at fault ends the claim entirely. Texas has worked that way for years. Your insurer now has a reason to push blame onto you that it did not have before 2026.
The proof has a short life
Event data recorders, traffic and business camera footage, and the vehicles themselves get overwritten, deleted or repaired within weeks. Photographs and a prompt preservation demand are worth more than argument later.
What not to do
Do not give the other insurer a recorded statement, and do not take a quick offer before anyone knows what the treatment costs. Both are cheap for them and expensive for you.
